Notes for CHARLES GARRETT:

"Charles Garrett did make a sworn Declaration and Corroborating Affidavit to perfect titles to land entered for actual settlement and cultivation under the Graduation Act of August 4, 1854. The declaration does in part state that Charles Garrett did appeared before land officials and did swear that he had been residing on the land since January 1855 and that he had a dwelling house and almost thirty acres of land in cultivation. And further that he had made no contract or agreement to either directly or indirectly sell or transfer the land to another party. Charles Garrett signed his mark, an "X". In the accompanying Corroborating Affidavit James Miller did swear that he is well acquainted with Charles Garrett and knows him to be the same person and is now and has been residing on the said land since the 1st day of January, 1855 and that his statement in regard to the improvements on the land, he knows from personal observation to be true. James Miller signed his name the same day, November 18, 1858.

The land was 40 acres located in the SW ¼ of the NW ¼ of Section 13, Township 3 North, Range 25 West. The Graduation Certificate No. 4541 was officially issued to Charles Garrett on March 1st, 1860.

A search of the Yell County Tax records show that Charles Garrett was taxed and paid his taxes in 1851, 1852, 1854, 1855, 1856. We did not find Charles on the Tax list for 1853. (This may have been oversight on our part or the Tax records). Charles was not on the Tax Records for 1860 (that we could find). On the 1861 Tax Records we found that Charles Garrett paid tax on 40 acres of land. The 1862 Tax records showed that Charles paid taxes on 200 acres of land.

1855: Garrett, Charles 1, 3 - $ 52

 

Email info ... We found no Tax Records for 1863, 1864, 1865, or 1866. The Library Director told us that was normal for the period due to the disruption caused by the Civil Was. Further, that Arkansas was is such disarray it was not until about 1867 before order was restored and County Government begin to return to normalcy and began to function again.

 

On the 1867 Tax Records we found an entry for taxing Charles Garrett "Heirs" for 120 acres of land. We found no other tax records for Charles in 1868 or following years. I conclude that Charles had died during the Civil war. He may have been in some part of the conflict or he may have been caught up between the northern and southern sympathizing Arkansas Bushwhackers. Certainly he could have just as easily died from any accident or sickness. Arkansas historian Russell Baker of the Arkansas State Archives told me: There was so much lawlessness in Arkansas during those years it is most likely he was killed by one side or the other by their famous "Bushwhackers" or Home Guard." I found no will, probate, marriage licenses for any of the children.

 

The Tax records for 1868 the only Garrets we found were John Garrett and Chesley Garrett. John Garrett had no land tax, but Chesley Garrett was taxed on 120 acres of land. This might or might not be the same 120 acres Charles had paid on in prior years stated above. We do not know who John Garrett or Chesley Garrett are nor if there is any connection to Charles Garrett.

 

Circuit Court "Book A" page 228, November 9, 1881, we did find a court action that substantiates that Charles Garrett has died before 1881. In the court action there was a dispute between George Morgan and Robert Smith Heirs. An error had been made in the legal description to the land Charles Garrett had made cash purchase of from the US land Office as described above. The court proceedings stated in part that: "the said Charles Garrett did on the 30th day of July 1859 for and in consideration of the sum of six hundred dollars cash in hand which was at the time acknowledged to have been paid by Robert Smith then a resident of said Yell County ." It went on to state that the deed was duly recorded and that a mistake was made in the preparation of the deed, stating it was the SW ¼ of the SW ¼, section 13, T3N, R25W. It should have been the SW ¼ of the NW ¼, Section 13, and T3N R25W. The court proceedings then stated: " that further that said Charles Garrett and Robert Smith have since that time departed this life and that the plaintiff said Cristorriah Smith is the widow and relic of said Robert Smith deceased ."

 

My conclusion is that Isaac Garrett and Merrill Simpson Garrett lived in Yell County Arkansas until about 1854 0r 1855. Isaac Garrett is on the 1854 Tax Rolls, but is not on the 1855 Tax Rolls. My guess is that about that 1854/1855 time period, Isaac died and is buried in Yell County Arkansas. And Merrill Simpson for his own reasons left Yell County, Arkansas with some of the early families such as the Maxwell's or Davis's and immigrated to Llano County Texas. Another possibility (and just as likely) is that Isaac and Merrill Simpson may have both left Arkansas together with one of these families for Texas and Isaac died en route. Or Isaac might have actually arrived in Texas and then died. We looked in several cemeteries and all of the cemetery index books and found no Isaac or Charles Garrett. The situation is that practically all of the gravestones prior to about 1870 are simple little head and foot stones of native sandstone. It appears that most never had an inscription and those that did had long ago eroded beyond legibility. " email C. G. 8-10-01

 

They are both in the home of the Petersons (grandparents I assume) in the 1850 census.  Isaac and son Simpson Garrett were in the home of Charles Garret in Yell County, AR. We do not know the relationship between Charles and Isaac. Possibly brothers.   Isaac is buried in Yell County.  Merrill Simpson Garrett came with other families to Llano County between 1855 and 1860. email B. J. R. 6-12-07

2.  ISAAC² GARRETT (SAMUEL¹) was born Abt. 1806 in AL.  He married (1) UNKNOWN Abt. 1830 in poss Limestone Co., AL.  She was born Abt. 1806, and died Bef. 1840.  He married (2) ELIZABETH PETERSON August 15, 1842 in Limestone Co., AL, daughter of JOHN PETERSON.  She was born Abt. 1807, and died Bef. 1850 in poss AL.

"1840 Limestone County Alabama Census there is an ISAAC GARRETT living near CHARLES GARRETT. The children's ages are right for Merrill Simpson to be Isaac's son. We believe that Isaac's brother was Charles Garrett. Living nearby is a SAMUEL GARRETT who may be Isaac's father.

 

Charles Garrett was deeded land in northern Limestone County AL in 1849. That same year he sold the land and moved to Yell County, AR where he was granted other land.  There are Miller families who are intertwined with the Garrett's and are living nearby. Charles wife was Ruth Miller. The witness for Charles to obtain land in Yell County Arkansas is a Miller.

 

1850 Yell County Arkansas Census: CHARLES GARRETT b.1812 AL; wife RUTH MILLER, b.1813, NC.  also in the same household it list Isaac Garrett, age 44 and Simpson Garrett, age 16.

 

Charles and Ruth Garrett had 7 children: ELIZABETH b.1838, POLLY b.1841, JAMES CARTER b.1841, LOUISA A. b.1843, JOHN H. C. b.1848, and MILLY F. b.1850. All children were shown as born in Alabama except Milly who was born in Arkansas.

 

Merrill Simpson Garrett leaves Yell County AR & by 1855 he is in Llano Co., TX.

April 1, 1855, he is issued a marriage license and marries MARGARET HELEN COWAN daughter of another pioneering family in the Llano, TX area. Merrill Simpson's life is well documented from that time on.

 

In an old family bible there is a paper hand written by a grand daughter of Merrill Simpson Garrett that states: "My great grand daddys name Ike Garrett to (2) brothers John and William to (2) sisters Mary and Abigail". She wrote in another place: "Ike Garrett married Susan Jarrett" and that both were from Alabama. Nothing has ever been known or found of the two brothers. Family assumptions are that "they went west" and were never heard of again?

 

James Carter Garrett, oldest son of Charles is a cousin of Merrill Simpson Garrett, and later settled in Llano  near where Merrill Simpson Garrett settled. James Carter died in 1933 and his obituary states that "he was born in Northern AL. He removed to AR when he was nine years of age. His parents and other family kin went by the way of the TN & MS River on a boat constructed especially for the pioneer movers use. They built the boat themselves"

 

1850 Limestone Co., AL Census list JOHN PETERSON and his wife MARY PETERSON, with them are ABIGAIL GARRETT age 8 & MARY JANE GARRETT age 11. These girls are connected to Isaac Garrett and may have been his daughters by a previous marriage as a marriage license was issued to Isaac Garrett and ELIZABETH PETERSON in August of 1842. The license was not returned. ?

 

Abigail Garrett, later shows up in Llano, Texas. Mary Jane Garrett becomes the wife of ANDREW MILLER  in 1857 & they were living in St. Augustine, TX  in 1861. There is a family letter to support Abigail and Mary Jane being sisters of Merrill Simpson Garrett." C.G. of NC 8-10-01 also K. R. 2-13-07.

The couple had 9 children together, 4 dying as infants and another age 10, but Abigail died in April 1878, along with her infant son, and Ike married a 3rd time. Isaac Byler "Ike" Maxwell second wife was Abigail C. Garrett, half sister to old Major and Mary Jane Garrett.  His third wife who was Mary Elzari Davis.  Limestone County, AL is where old Isaac came from.  Abigail had 9 children, 4 dying as infants and another age 10.  She died with her infant son in about 1879 and is buried at Bluffton cemetery. 3.  MERRILL SIMPSON³ GARRETT (ISAAC², SAMUEL¹) was born 1833 in Limestone Co., AL, and died Aft. 1910.  He married (1) MARGARET HELEN COWAN April 01, 1855 in Burnet or Lee Co., TX.  She was born 1838 in Lincoln Co., TN.  He married (2) ANNIE KNOWLES March 24, 1895.  She was born 1855.

 

Notes for MERRILL SIMPSON GARRETT:

"There has always been the family lore that Merrill Simpson "left Tennessee at an early age and joined the Civil War, came to Texas, and never went back home." We know that he was only 16 when he was in Arkansas in 1850. And that it was ten years after coming to Texas that he enlisted as a private in CO. A, Martin's Regiment Texas Calvary (5th Partisan Rangers) on April 27, 1862. He was discharged 26th of May 1865 in Millican, Texas with the rank of Sergeant.

 

Another family lore is that he "left home and came to Texas with a cousin and never returned" I believe the cousin is James Carter Garrett son of Charles Garrett. James Carter Garrett was too young (age 10) to come to Texas at the time Merrill Simpson Garrett is documented as being in Texas.

Merrill Simpson and Margaret Cowan were issued a marriage license April 1, 1855, in Burnet County Texas. Further, James Carter Garrett joined the Confederacy in Arkansas where he enlisted in the Yell County Mounted Rifles."  C. G. 8-10-01

"1860 census-Llano Co., Texas I found Merrill Jr. with Margaret's family (Cowan).  He's listed as S. M. Garret, with Margaret H. and Joseph V.

 

1870 census, I scrolled through all of Llano Co., and he's spelled Murrel S. Garetts.(Sr.)

Haven't found 1880 or 1890 yet.

Margaret died around 1890 (don't have proof when)

 

He married Mrs. Annie Knowles.  Most of the names are spelled wrong.  He had another son in May 1887, Marion S.(spelled Mansy).  He married Annie 24 Mar 1895-Texas Marriage Collection, and had a daughter with her, Katie Iona, b.Mar 1897. (she's listed as Iowa)  He also has 3 granddaughters living with them, but I haven't figured out which of his children they belong to yet. (Sr. also).

This is the only record found of Andy and Mary together. They were married in 1857 and had 4 children, then Mary and children show up in Llano 1870 with William H. Tow.

Andy was 9 years older than Mary. Could he have been married before?

Maggie said she quit school at 16 to care for her mother. That would have been in 1916. Granma Allie died in 1918, so Allie was sick for at least 2 years.

 

"Allie was raised by Mr. Parker. She had older brother named Jim. Jim worked on the railroad. Jim had only 1 leg, may have died in San Angelo". Rosie Jobes said in 1957.
