Know all men by these presents that I William Procious of Mahoning Township in the County of Armstrong and State of Pennsylvania.

Farmer being in feeble health but of Sound and disposing memory do Make and publish this my last Will and Testement.

And as to my worldly estate and all property real personal or mixed of which I shall die and possess or to which I shall be entiltled at the time of my decease.

I devise bequeath and dispose thereof in the manner following to with.

First: My will is that all my just debts and funeral exspences shall by my Executors herein after named be paid out of my estate as soon after my decease as shall be convenient.

Then I give to my beloved wife Catharine Procious the use of my farm where I now reside in the Township of Mahoning County State of Pennsylvania ajointing lands of Jacob Miller heirs Fairmount Coal Company Joseph Craig Elia and John Kunselman.

Containing one hundred and six acers more or less.

Together with the improvements and income thereof and also all the live stock farming utentsils and all my household furniture excepting such of my live stock herein after otherwise devised for and during her natural life that if she shall so long remain my widow and should my said wife not remain my widow during her life time and at her remarriage all the bequests to her herein above mentioned or at her death shall be by my Executor herein mentioned Sold except the farm or tract of land given her which is otherwise hereinafter devised and the proceeds of said sales of property shall be paid to my legal heirs share and share alike.

I futher give devise and bequeath to my said wife six hundred Dollars in a judiciary note I hold against John Rittinger John Miller and Jacob Kiehl dated May 2 1887 payable in one year with interest to have and to hold the same forever provided that my said wife shall furnish my two daughters Ellen and Mattie Procious whom having not arrived at the age of twenty one years at their each maturity with such live stock and household furniture out of said six hundred Dollars the same as my other daughters received from me at their maturity or marriage.

And the bequest and devise to my said wife shall be in lieu of her right and claim in my estate under the intestate laws of the Commonweath of Pennsylvania now in force or as hereafter to be passed.

I give and devise a three year old horse to my son Edwin Grant to be delivered to him in June 1889 at his arriving at age of twenty one years.

I give and bequeath to my son Reuben a like horse to be given to him at his arriving of the age of twenty one years and my Executors herein after named is especially in charged with the proceeding and delivery of the same to and for my said son Reuben out of my estate.

Should there not be any such stock on my said farm aforesaid also two head of sheep and two hogs also two head of sheep and two hogs to my son Edwin Grant herein before mentioned.

I give and bequeath and devise to my son William Procious one cow and one-one year old calf two sheep and two hogs.

I futher direct and authorize my Executors to pay out of my estate not otherwise devised two hundred dollars to each of my children who have not at my death received the said amount or sum of two hundred dollars and that a record of such of my children to whom I have paid any money will be found in my book of advancements to my children.

I give and devise my afore said farm given and devised to my wife during her life time or to her unmarriage to my son Reuben Procious to be his and to his heirs forever at my said wifes death or her remarriage.

And my said son shall pay the sum of fifteen hundred dollars to pay to my estate or legal heirs in five annual payments of three hundred Dollars each and should my said son Reuben decline to take said farm as aforesaid, then my Executors shall sell the same and the proceeds thereof shall be paid to all my legal heirs and represenatives share and share alike.

And lastly I do nominate and appoint my son Henry Procious and my son-in-law Rollin Shoemaker to be my Executors of my last Will and Testement.

In testemony whereof I the said William Procious have to this my last Will and Testement.

Subscribed my name and fixed my Seal this ninth day of November 1888.

PROBATE OATH

State of Pennsylvania, County of Armstrong, ss:

Personally came before me, H. J. Hays, Register of the Probate of Wills and granting Letters of Administration, in and for the County aforesaid.

J. H. Morrison & Wm Buffington the subscribing witnesses to the forgoing Will, who being duly sworn according law, do say that they were present, and saw and heard Wm Procious the testater within named, sign, seal, publish, pronounce and declare the foregoing instrument of writing as and for his last will and testement, and that at the time of so doing he was of sound mind, memory and understanding, to the best of their knowledge and belief.
