To the Honorable the Judge of said Court:

The petition of Ruben S. and Mattie G. Procious respectfully represents:

That your petitioners are minor children of William Procious late of Mahoning Township in said County and have no guardian to take care of their persons and estates: and that their is a personal estate income amounting to about four hundred dollars for each of them from their said father's Estate.

They therefore pray the Court to admitt them to make choice of a guardian for the purpose aforesaid.

And they will ever pray the Court.

Petition Of

Ruben S. Procious Mattie G. Procious guardian of said minors, and directs that he gives bond in the sum of eight hundred Dollars, on said case with surety to be aproved by the Court.

And Samuel Kunselman is appointed is appoved as his surety.

And now this 13th June 1892, unpon reading within petition the Count appoint William Procious To the Honorable the Judge of the Orphans' Court of Armstrong County.

The petition of William I. Procious gardian of Mattie Procious and Ruben Procious minor children of William Procious late of Mahoning Township (Deceased) resectfuly represent.

That the said William Procious being seised in his demise as of and in all that certain tract piece parcel or tract of land situated in Mahoning Township Armstrong County and State of Pennsylvania.

Bounded and described as follows to wit:

Beginnng at the south west corner at a post, thence by lands of George Shumaker north eighty nine degrees sixty two percels to a post thence by lands of John Grinner north one degree east, one hundred and seventy eight percels to a post, thence by lands of North Western Coal Company and Iron Company south eighty nine degrees east sixty five percels to a post, thence by lands of same south two degrees west one hundred and seventy eight percels to the place of the beginning.

Containing seventy acres and fourteen percels of land, that said decedent died on or about the fourteenth day of March 1889 intestate as to said estate leaving to servive him children as follows to wit:

Elizabeth intermarried with Abraham Bodenhom

Henry Procious

Catherine intermarried with Wesley Doverspike

J. C. Procious

Susannah Lankard

Jamie Shumaker

William I. Procious

Carrie Morrison

E. G. Procious

Mattie Procious and Ruben Procious miners his only heirs at law.

All of whom are of full age except the said Mattie and Rueben Procious minors as aforesaid, for whom your petitioner was by this Honorable Court duly appointed Guardian.

That the parties in interest who are said first have agreed and entered into a contract to sell and convey the said premises above described for the price or sum of two thousand two hundred Dollars and your petitioner is informed and belives it is for the best interest of the said minors that the said sale should be perfected and that the above price is a full and fair one and that the sale at that price would be advantageous to said minors.

Your petitioner therefore prays the court to make a order and and decree authorizing and empowering him to join with the other parties in interest who are in granting and conveying the said premises to said purchaser, his heirs and assigns upon receipts of the shares of said minors or its proportions of the consideration therefor due them to wit:

For the said Mattie Procious it is one thirteeth part thereof, or the sum of one hundred and sixty nine dollars and twenty three cents and for said Ruben Procious one hundred and sixty nine dollars and twenty three cents, as provided by Act of Assembly in said case made

In the matter of the petition of William I. Procious, guardian of Mattie Procious and Ruben Procious, minor children of William Procious, late of Mahoning Township, (Deceased) to sell the undivided interests of said minors in certain real estate, presented to the Orphans' Court for the County of Armstrong, on the 5th, day of December A. D. 1892.

To the Honorable Calvin Rayburn, Judge of the Orphans' Court for the County of Armstrong.

I do hereby certify that under and by virtue of the Order and decree of this Honorable Court, made on the 5th, day of December A. D. 1892, I have sold the two undivided thirteenth part of the said minors, of and in the premises in sid petition described, subject as therein mentioned at the sum or price of one hundred and sixty nine dollars and twenty three cents ($169.23) per thirteenth part or share, or for the full sum of three hundred thirty eight dollars and forty six cents ($338.46) as the two undivided shares of said minors, and that I became the purchaser of said land for the cash price or sum of two thousand two hundred dollars in accordance with the prayer of said Petition, and the order and degree thereupon, which sale so made I pray the Court may be confirmed.

Before me the subscribed, a Justice of te Peace in and for said Count, personally came the above named William I. Procious, guardian of Mattie Procious and Ruben Procious, who being duly sworn says that the facts set forth in the forgoing return of sale are true and correct.

Know all men by these presence, that we W. I. Procious and M. M. Shoemaker of the Township of Mahoning and County of Armstrong are held and firmly bound to the Commonwealth of Pennsylvania, in the sum of six hundred dollars ($600.00) lawful money to be paid to said Commonwealth; to which payment well and truly to be made we do bind ourselves, our heirs, executors, and administrators jointly and severally firmly by these presence.

Sealed with our seals and dated the 19th day of January A. D. 1893.

The condition of this onligation is such that if the above bounded William I. Procious, guardian of Mattie Procious and Ruben Procious, minor children of William Procious late of Mahoning Township. and County of Armstrong and State of Pennsylvania (Deceased) shall and do made a proper application of all money to be received from sale of Real Estate of said wards, according to the trust and decree of the Court, then the above obligation to be void, or else to be and remain in full force and virtue.

And now to-wit this 6th day of March A. D. 1893, the within and foregoing return of sale presented in open Court.

And it appearing to the Court that the land described in the premises and the interests or shares of the wards of said guardian were sold by him accordance with the terms of the Orphans' Court, authorizing him to make said sale and said William I. Procious, guardian as aforesaid became puchaser of said land and upon due consideration the said sale is confirmed and is to become absolute in ten days and R. S. Slaymaker, Clerk of the Orphans' Court for the County of Armstrong is herby authorizied and directed to make, execute and deliver to said William I. Procious, purchasher a deed in free simple for all the right, title, interest and claim of said wards Mattie Procious and Ruben Procious, of and to said land.

Upon filing a Bond with appoved sureties and according to law in such case made and provided.
