Will Jacob's will
is on file at Chambersburg, Franklin County, Pennsylvania, in Will Book
Six, pages 82 to 84. Following is the complete text of the will which
shows the original spelling. The blank spaces are where the will is not
legible:
"In the name of God Amen - I Jacob Shockey of Washington
Township, Franklin County and State of Pennsylvania being weak in body but
of sound mind memory and understanding, blessed be God for the same, but
Considering the uncertainty of this Transitory life do make and Publish
this my last will and testament in manner and form following to wit;
Principally and first of all I Commend my Immortal Soul into the hands of
God who gave it and my body to the earth to be buried in a decent
Christian like manner at the discretion of my executors herin after named
and as to each worldly Estate wherewith I have been blessed in this life I
give and dispose of the same in the following manner to wit; first I give
and devise unto my beloved wife, Anna, one bed and one sted two cows two
pewter Dishes Six pewter plates six spoons one frying pan two iron pots
and one chest one spinning wheel two sheep and I also give and devise unto
her the third part of all the grane that will be raised of that part of my
Real Estate hearin after Devised to my Sons Isaac and Christian to be
delivered unto her in the bushel and also the third part of all the hay
made to be hawed home and put on the Stable whenever She Choseth and also
to have the third of the hemp and the flax and the third of the frute. I
also will and devise unto her one ten plate stove and pip and Pasture in
the summer time for two cows and her sheep and is to have the Liberty of
keeping two hogs in the plase Every year and is also to have the
Priveledge of one room in the new house which ever she chouses and the use
of one half of the Cellar and is to be provided with a sufficiency of fire
wood by my two sons Isaac and Christian to Hall and Cut the wood to the
house and to cut it to her youse to hold and enjoy all the Preveleds afore
said during her natural life and from and immediately after her decease I
give and devise all property She may have left unto my children herein
after named to be equally divided between them. I Also will and devise
unto her all the hemp I now have and all the flax and is also to have the
use of one half of the gardin During her natural life and also the use of
as much Stable Run as What's necessary. Next I will and devise unto my two
sons Isaac and Christian the plantation I now live on all and also all my
land I own in the County of Washington in the State of Maryland Except
fifty acres a Jineing Bals hill and tise yongs John Funks lines and also a
track of twenty acres on the Cows Run called in the patent the Land of Nod
and another tract of land Lying in Pennsylvania where Samuel Bigler now
lives on and also three trak of lands is to be sold before mensioned at
Public Sail by the executors of the said Jacob Shockey and also my
daughter Susanna and married to Samuel Bigler is to have one hundred
Pounds out of the three discribed of lands menchened above and the rest to
be equally devided amonst my children it is my will that all the money I
owe to my sons Isaac and Christian in Bonds lots and Book accounts is to
be in part of the land I have willed to them now and the remainder is to
be paid as will hereafter mencion to hold and enjoy the aforesaid Divided
Land and premisses with the appurtances thereon unto them the said Isaac
and Christian their heirs and assigns forever to hod the same in common
until they think Proper to make a devision of the same. Next I will and
devise unto my son Jacob together with what he hath already Receive from
me the sum of forty seven pounds five shillings. Next I will and devise
unto my daughter Magdalena married unto Balser Mowen unto them with what
they have already Received the sum of one hundred and Nonety six pounds
Eight Shillings. Then I will and bequeath unto my daughter Barbara Married
to Peter Heck together with what they have already Received the sum of one
Hundred and Seventy five pounds. Next I will and devise unto my daughter
Anna Married to George Heck the sum of ________ Hundred pounds Next I will
and devise unto my daughter Eve married to John Nichols the sum of one
hundred and eighty fore pounds Eight Shillings and six pence Together with
what they have already Received - Next I will and devise unto my daughter
Susanna married to Samuel Bigler the sum of one hundred pounds besides the
one hundred before menscion. Next all the Legacies Devised affore said is
to be paid to my two sons Isaac and Christian. That is to say one year
after my decease they shall pay unto my son Jacob the sum of Forty Seven
pounds five shillings and next one year after the said Isaac and Christian
shall pay unto my Daughter Magdalena married to Balse the sum of Sixty
pounds and the Next one year after unto my daughter Barbara married to
Peter Heck the sum of Sixty pounds Next year after to my daughter Eve
married to John Nichols Sixty pounds and then Next one year after to pay
my Daughter Susanna married to Samuel Bigler the sum of Sixty pounds. Then
so on in Rotation as above mentioned until each of their full Shares is
full paid unto Each of them my children all the foregoing to be paid
before George or my Daughter Anna to to receive any part of there legacy
and the said Isaac and Christian shall pay the sum of fifty pounds yearly
until the pay all of the Legacies before Mention.
"It is my will that my Executor shall be fully impowered to make
Sufficient title for as I my self for there described Lands above
mentioned it is my will that all my just Dets and true dets shall be paid
by my Executors. I nominate constitute and appoint my son Jacob and my
wife Anna to be executors of this my last will hereby Revoking all other
wills Legacies and bequests by me heretofore made and Dislowing this and
___________ and it is my will that all my household furniture and also the
remainder of my stock to be sold at publick Sail after my Decease No other
to be my last will and testament in Witness Whereof I the said Jacob
Shockey have here unto set my hand and seal this Ninthe day of August in
the year of our Lord Eighteen hundred and three.
