Will of George Adam Zettlemoyer, 1836, Berks Co PA

In the Name of God Amen. I George Adam Zettlemoyer of the township of Greenwich in the County of Berks & State of Pennsylvania, Farmer, being sick & weak in Body but of Sound memory & understanding (praised be God for it) and considering the certainty of death, & the uncertainty of the time thereof, and to the end I may be better prepared to leave this world whenever it shall please God to call me hence, I, therefore make & declare this my last Will & Testament in the Manner & form following To wit: First, it is my will & I do order that my just debts and funeral expenses be duly paid and satisfied as soon as conveniently may be after my deceased. _Item I give & bequeath unto my dear nice, Catharine Klose, one cow, together also one Acre of Meadow ground Situate Eastwardly from my new House in Greenwich Township, which said Acre of Land shall be pointed out by the said Catharine Klose & to be surveyed in a right angular form in four lines, according to her satisfaction., and my Executors herein after named Shall built a good one Story Log house on Said Acre of Land, eighteen by twenty feet, as soon as conveniently can be after my decease, and as long as Said house is not built & remains unfinished, the said Catharine Klose shall have the use & occupation of said House which I now recite, and my Executors herein after named shall put said Acre of Land in a Good new fence, & the Costs and charges for making said fence, for building said House & for Surveying the same shall be paid out of my estate. _Item. It is my will & I do order & direct that the said Catharine Klose Shall have the use & occupation of said new built House & one Acre of Land during her Natural life, and after her decease, the same shall fall back again to same land where it was Surveyed off, Originally, together with all the improvements thereon. Item. I give and bequeath unto my daughter in Law Philip Sously, during his natural life, (provided he remains single & unmarried) the use & occupation of a certain Messuage or tenement & tract of Land situate in Albany Township. containing about ninety eight acres, be the same more or less with the appurtenances, now in the possession of the said Philip Sously, and after his decease, or after he will or is married again, I give & bequeath the said Messuage or Tenement & ninety eight acres of Land, be the same more or less, with the appurtenances situate in Albany township aforesaid. bounded by lands of Peter Schwenk. Daniel Bailey, Peter Kline, & others unto my grant children, viz: Catharine Sously, Benjamin Sously, Polly Sously & Sally Sously and to their heirs & assignees forever, to be equally divided among them, Share & Share alike.

Item. I further give & bequeath unto my dear nice Katharina Klose, one Spinning wheel, one Iron pot, one dozen cups & Sarcers, Six plates & dishes, all to be taken at her choice, & all her wearing apparel. Item. It is my will & I do order & direct, that my Executors herein after named, or the Survivor of them shall as soon as conveniently can be after my decease, sell & depose off, by Public Vendue or Outcry, all my personal property, (not Otherwise Bequeathed) Also all my Real Estate Situate in the township of Greenwich, or elsewhere (not otherwise Bequeathed) for the best prices that can be gotten for the same, and for that purpose I do hereby authorize & empower my said Executors, or the survivor of them, to Sign, seal, execute and acknowledge all such or deed or deeds of conveyance, as may be requisite & necessary, for the granting & assuring the same, to the purchaser or purchasers thereof in fee simple, and the monies arising from such Sales, and the remainder & residue of my Estate of what kind and nature soever the same may be, (not otherwise bequeath) I give & bequeath of the Same unto my nine children, viz: Henry, George, Michael, Martin, George, George Adam, Catharina intermarried with Henry Reinhart, Susanna, intermarried with Sierous Parrot, Christian, intermarried with Daniel Hoffman & Ellzabeth, intermarried with John Bochert, and to their heirs & assigns for ever, to be Equally divided among them share & share alike.

Item. It is my will & I do order & direct, that in case any of my said children, do make a demand, sue for and recover any Sum of money for work done overage, then and in such case any such child or children, shall receive no share of Legacy or Legacies, & shall be expelled out of my will & Testament. & such share or shares shall be divided among my other children Share & Share alike.

Item. It Is my will & I do order & direct, that Sierous Parrot, have received heretofore from me in Land for the value of eight hundred Dollars, which said sum of money shall be deducted from his share of Legacy, after my decease. _Item, It is my will & I do order & direct, that my son Henry, have received heretofore from me in Cash, the sum of three hundred & ninety six pounds, which said sum of money shall be deducted from his share of Legacy, after my decease.

Item. it is my will & I do order & direct, that my two Sons, Martin & George, have received heretofore, Each of them from me in Land, for the value of five hundred pounds Each, which said sums of money shall be deducted from their Shares of Legacy�s after my decease.

And lastly I nominate constitute & appoint my two Sons Martin & George Zettlemoyer, to be the Executors of this my Will, hereby revoking all other Wills, Legacies & Bequests, by me heretofore made, and declaring this & no other to be my last Will & Testament.

In witness whereof I have hereunto set my hand an Seal, the twenty seventh day of March A.D. One thousand Eight hundred & thirty Six.

Signed sealed & declared by the said Testator, as his last Will & Testament in the presence of us.

On the 22d day of April AD 1836, appeared Israel Derr & John Frey, witnesses, & being duly sworn according to law, did depose & say, that they were present, saw & heard the Testator sign, seal publish, pronounce & declare, this instrument of writing, as and for his last Will & Testament, and that at time of the doing thereof, he was of sound mind, memory & understanding, to the best of their Knowledge, observation & belief.
