John Hightower & Mary, his wife; Christopher Robertson & Mary, his wife; Benjamin Edmundson; and Edgecomb Sugget & Constant, his wife to Joseph Smith. 17 May 1779, 2500 pds, 380 acres in Amelia Co. known as Edmundson’s Ordinary on B/S forks of Irby’s and Cocke’s roads, and adj. Line of William Ford. The will of Upton Edmundson late of Amelia Co., stated that after the death of his wife, his daughter Mary (meaning Mary Robertson) would inherit the plantation whereon he then lived; further if his daughter Mary should die without an heir, her estate was to be equally div. Between his son Benjamin Edmundson and his [Upton’s?] daughter Constant. They, therefore convey this land to said Smith.
Wit: Peter Lamkin, Christopher Ford, Nathaniel Robertson, John Bruce & D. Stokes. Rec: date not entered.
It appears "John Hightower and Mary, his wife" would have no interest in the legacy unless Mary (_?_) Hightower was widow of Upton Edmundson, also meaning the widow of Upton was not deceased at time of deed, but gave up her right because of remarriage../jgs
Note: Nottoway Co., VA was formed 1788/1789 from Amelia, and apparently included this portion of Amelia. See article on Edmondson's Ordinary in Nottoway.

Amelia Co., VA DB 15:172 Commmission and Dower Relinquishment. Mary, the wife of John Hightower; Mary the wife of Christopher Robertson; and Constant, the wife of Edgecomb Sugget could not conveniently come to court to relinquish their dower rights in land their husbands and Benjamin Edmundson sold to Joseph Smith by deed d. May 27, 1779. Therefore, on June 24, 1779 Thomas Tabb and John Glenn were appointed to obtain them. This was done in Lunenburg Co. (VA) and returned on July 31, 1779; Rec: Peter Lamkin, Nathaniel Robertson & David Stokes on Aug 26, 1779.

It appears all females were required relinquish dower interest, except unmentioned wife of Benjamin; thus it seems Mary, the wife of John Hightower was same as widow of Upton Edmundson d. 1771 Amelia Co.

[Note: The 1779 dower relinq. was 16 years before1787 when one Christopher Robertson married Constance Edmundson born 1766 (d/o Benjamin Edmundson). She would have been 21 when she married in 1787; thus not the same Constance and prob. not the same Christopher/jgs]
